What is Breach of Confidence?

This became more so in October 2000 with the incorporation of the European Convention on Human Rights into English Law. Article 8 of the Convention states that “Everyone has the right to respect for his private and family life, his home and his correspondence” But with this comes certain rules and exceptions and defence arguments. The most important defence to a breach of confidence is known as “public interest” where the public interest in divulging the information outweighs the duty of confidence.
