PROBATE FEES

About Michael
Michael qualified as a Solicitor in 1983 and became a Partner in a law firm the same year; he is a member of the Law Society, a member of the Law Society Personal Injury Panel and a member of APIL with senior litigator status.
Michael has experience in handling all aspects of probate.

MTA FEES – Probate (applicable to uncontested cases, where all assets are in the UK)
We anticipate this will take between 5 and 10 hours work at £200 + VAT per hour.
The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end.
We will handle the full process for you. This quote is for estates where:
• There is a valid will or whether there is not a valid will
• There is no more than one property
• There are no more than 3 bank or building society accounts
• There are no other intangible assets
• There are no more than 5 beneficiaries
• There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs
• There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
• There are no claims made against the estate
• There are specific executors who are able and willing to act

Disbursements included in this fee:
• Probate application fee of £155.00
• £5 Swearing of the oath plus £2 for each exhibit (i.e. the will) per Executor
• Bankruptcy-only Land Charges Department searches £2 per beneficiary
• £300.01 Post in The London Gazette and a post in a Local Newspaper– Protects against unexpected claims from unknown creditors.
Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

Potential additional costs
• If there is no will or the estate consists of any share holdings (stocks and bonds) there are likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can provide you with a more accurate quote once we have more information.
• If any additional copies of the grant are required, they will cost £0.50 per extra copy (1 per asset usually).
• Dealing with the sale or transfer of any property in the estate is not included.
• Requiring a Solicitor to act as an executor in the absence of executors.

How long will this take?
On average, estates that fall within this range are dealt with within 3 months. Typically, obtaining the grant of probate takes 8 weeks. Collecting assets then follows, which can take 4 weeks. Once this has been done, we can distribute the assets, which normally takes a further 4 weeks. Not every estate is the same and this time period will vary in different circumstances.



MTA FEES – Probate – Taxable Estates (applicable to uncontested cases, where all assets are in UK)
Please note the fees and timescales quoted below are in addition to those quoted for non-taxable estates.
Inheritance tax is payable on the estate generally when the amount of the estate exceeds £325000.
There are reliefs applicable to married couples and where property passed to direct descendants. There may also be reliefs dependent upon where business and agricultural property are being transferred.
Where the estate is over £325000 and Inland Revenue return needs to be submitted to the Capital Taxes office this can be a complicated and time consuming document to complete.
It may well be that if inheritance tax is payable contact may have to be made with the Capitals Taxes office to facilitate payment of inheritance tax from a separate account or on credit.

As a very rough guide we would estimate to complete inheritance tax forms on a simple estate which includes property and assets in UK to take no more than 5 hours work at £200 + VAT per hour. A complicated estate can involve considerably more time.
This does not apply to any cases where there is a dispute or potential dispute about validity of will/ construction of will/ identity of beneficiaries/ capacity of testator and varies considerably dependent on the following:
• If the estate is more complicated
• If there are multiple properties
• If the estate includes foreign assets

How long will this take?

Once the inheritance tax account has been sent to the Capital Taxes office they will assess the form submitted and this may take time. Only when they approve the tax form, can probate be applied for. Generally speaking, they can take 4 weeks to provide forms, once done, application for probate can be made which will take another 4 weeks. Once this is done, we can then distribute assets.
