Financial and Property Issues and Disputes

What should I consider next?

Whether you and your ex-partner can reach an agreement or not, you may want to consider these fundamental concepts:
  • Full financial disclosure from both parties. Prior to dividing any family finances, it must be determined what exactly needs to be divided in terms of income and capital.

  • Any financial settlement should be formalised in a court order. Once formalised, the parties are bound by the settlement and if there is any default that the settlement can be enforced.

  • If an agreement is reached between both parties once court proceedings have started, a court order will still be necessary. The court always retains the power to approve an order or not.
