Product Liability Law

Product liability is when a manufacturer, a supplier, a distributor or anyone who makes products available to the public is held accountable for any injuries the product causes. If someone is harmed or injured by a defective product, they are entitled to make a claim for compensation from the person who made it or sold it. If a claim is made, the rules of Product Liability Law will apply.

Product liability rules come from, Statutory Law (Consumer Protection Act 1987), Contract Law and Tort Law.

Regardless of what area of the law you make a claim in, you must be able to prove that
:
  • The product was defective

  • The defective product caused some harm or a loss

  • The person is legally responsible for the defective product

Consumer Protection Act

The consumer protection Act 1987 sets the standards used in product liability cases and the law states that if a product causes personal injury and the injury was not due to misuse, consumers are legally entitled to make a product liability claim for compensation against a manufacturer or retailer responsible.


Time Limit For Making a Claim

When making a product liability claim, the claim must be issued within 3 years of the date of injury. Failing to make a claim within this time will cause the claim to be 'statute barred' or disallowed. If however, you suffered an injury which happened more than 3 years ago, you may still be entitled to make a claim if you found out that the injury was caused by the defective product within the last 3 years.
