Faulty or Defective Products
Most faulty product purchases simply lead to a minor annoyance and there is only a need to return the item in question to the retailer or manufacturer for a replacement or refund. However, in a minority of cases, individuals and their loved ones, including children, can be injured by the products that they buy, through no fault of their own. Personal injury claims are often the only means available to those individuals to access the compensation to which they are entitled.
Suffering an injury as a result of a defective product is rare; however there are a minority of cases where individuals have been injured through no fault of their own. With cases such as this, the manufacturer is usually liable for any harm or damage to the consumer. If you have been harmed or injured by a defective or faulty product you may be entitled to claim compensation from the person who made or sold it.
Some of the most common injuries caused by defective products include burns caused by malfunctioning hair styling equipment, burns or rashes from ‘toxic sofas’, scaring or injury to skin after use of contaminated beauty products, injuries to hands or fingers caused by poorly designed pram hinges or salmonella from consuming factory produced confectionery.
Time Limit For Making a Claim
When making a product liability claim, the claim must be issued within 3 years of the date of injury. Failing to make a claim within this time will cause the claim to be 'statute barred' or disallowed. If however, you suffered an injury which happened more than 3 years ago, you may still be entitled to make a claim if you found out that the injury was caused by the defective product within the last 3 years.
